California is home to some of the most progressive diversion, or alternative sentencing laws in the country. After the passing of Proposition 47, which allowed a “Deferred Entry of Judgement (DEJ)” for drug-related cases, and Senate Bill 666, which offered the same to individuals suffering from issues of mental health, Californians have been able to seek meaningful treatment in lieu of traditional punitive measures. In practice, this often looks like court-mandated attendance to a recovery program with a dismissal of proposed charges upon completion. Types of Drug Charges
The consequences of being charged with either Driving Under the Influence (DUI) or Driving While Intoxicated (DWI) can have a long impact on an individual, whether they are an adolescent or an adult. If convicted, drivers often have to serve jail sentences, pay substantial fines or have their driver’s licenses suspended. The BAC (blood-alcohol content) for conviction varies from state to state.
Under the Controlled Substances Act, nearly all illicit drugs, which are often referred to as narcotics, are deemed illegal to possess or distribute. Some of the most common are drugs like heroin, cocaine, methamphetamine, hallucinogens, and depending on the state, marijuana. However, not all controlled substances are illegal provided you have obtained them properly. This is the case with many prescription opiates and benzodiazepines, which have a high potential for abuse. Simple possession cases are often eligible for diversion in the State of California.
The difference between simple possession and intent to distribute is generally determined by the amount as well as paraphernalia confiscated during the arrest. Intent to distribute or trafficking charges carry a much stricter punishment, especially when coupled with prior convictions.
